Terms and Conditions of Sale Agreement
Terms This document contains the standard terms and conditions for agreements between A Star London Scaffolding (“the Owner”) and the company, individual, or public authority hiring scaffolding and/or related equipment (“the Buyer”). Unless modified in writing or by mutual agreement, these terms will be an integral part of any contractual agreement. The Buyer must review this document carefully before confirming the contract and contact us immediately with any questions. Please retain this statement for reference and share it as necessary.
Parties In these terms, the contract is made between A Star London Scaffolding (“the Owner”) and the Buyer.
Contract Terms This document outlines the terms for the hire, erection, and dismantling of scaffolding and all associated services. If the Buyer does not sign this agreement but accepts a quotation, or if these conditions have been made known through a quote or prior agreements, then proceeding with hiring equipment constitutes agreement to these conditions.
Ownership of Scaffolding The scaffolding remains the property of the Owner, and this contract does not confer any ownership rights to the Buyer. Upon termination of the contract, the Owner may reclaim the scaffolding without prior notice.
GDPR and Privacy A Star London Scaffolding holds and stores data in both physical and electronic formats. This data is collected to provide quotations and complete contracts. The personal data we hold may include names, email addresses, phone numbers, and property addresses. None of this data is sold and is only shared as needed to fulfill contractual obligations. Duration and Hire Period The hire period begins on the day when scaffolding is handed over and continues until the Buyer notifies the Owner in writing via email or by phone to off-hire the scaffolding. The standard hire period is twelve weeks from the completion of each stage, unless stated otherwise in the quotation. Five clear days’ notice is required for the removal of scaffolding. If the minimum hire period is not used, there will be no reduction in charges, and any additional hire after the initial period will be charged weekly.
Charges and Payment Terms
- Hire Charges: Weekly charges will apply after the initial twelve-week hire period, at a rate of 4% of the total item price per week.
- Quote Validity: Quotes are valid for 3 months from the date of issue unless otherwise agreed. Changes in permit or license costs may impact the quoted price.
- Credit Terms: Payments are due within 30 days from the end of the month unless otherwise specified. Late payments may incur interest charges at 5% above the base rate.
- Non-payment: The Owner reserves the right to charge interest on overdue amounts and may remove scaffolding equipment from the site if payments are not made on time.
Standard Working Hours Scaffold installation will be conducted between 7:00 am and 6:00 pm on weekdays, excluding statutory holidays. Work outside these hours will incur additional charges.
Aborted Visit Costs For visits where the Owner is unable to perform the agreed work, a minimum abortive charge of £350 will apply. The Buyer must ensure that access to work areas is always available and free of obstacles.
Site Conditions and Buyer Responsibilities
- Site Surveys: The Owner requires a minimum of 48 hours’ notice for site visits.
- Access and Permissions: The Buyer is responsible for obtaining any necessary permissions or easements for scaffold erection and dismantling, including encroaching on adjoining properties if required.
- Ground Conditions: The Buyer must ensure that all areas to be scaffolded are level, stable, and free of hazards. Any additional work due to uneven or unsuitable ground will incur extra charges.
Safety and Liability
- The Owner takes no responsibility for the safety of the scaffolding once the Hand-Over Certificate is provided. Any modifications to the scaffolding by the Buyer or third parties will void the Owner’s liability for any loss or damage.
- The Buyer is responsible for any losses resulting from damage, theft, or alteration of scaffolding by unauthorized personnel.
Licenses and Permits Upon request, the Owner can obtain necessary licenses and permits, which will be charged as additional costs to the Buyer.
Design Drawings Unless specified, design drawings are not included in the standard quotation. If required, they will be charged separately.
Damage and Liability The Owner will take reasonable care to avoid damage while erecting and dismantling scaffolding. However, the Owner will not be liable for damage to roofs, tiles, slates, guttering, or other roof elements.
Claims The Buyer uses the scaffolding at their own risk and indemnifies the Owner against all claims, except those arising from the Owner’s negligence.
Advertising The Owner reserves the right to place advertising on all scaffolding erected.
Welfare Facilities The Buyer must provide welfare facilities as required by regulations, without charge to the Owner.
Extension of Contract If the hire period extends beyond the agreed duration due to unforeseen circumstances, additional charges will apply.
